Steve Kurtz December 9, 2017 FOX NEWS The Supreme Court is expected to rule by June in the case of Masterpiece Cakeshop v. Colorado Civil Rights Commission, which involves a baker who refused to make a cake for a same-sex wedding. The high court heard oral arguments in the case Tuesday. Attitudes toward the case seem to have split along partisan lines. Liberals tend to see it as about illegal discrimination against sexual orientation. If someone had asked me back in the day, if, in 2017, we’d be having a discussion about whether a fundamentalist baker should be forced by the law to create a wedding cake for a gay couple, I’d have been gobsmacked, as the Brits say. Smacked in the gob because only a decade ago such a question would have seemed so remotely hypothetical as to be absurd. And yet, here we are. A Christian baker has taken a stand on the grounds of religious conscience and artistic freedom not to provide a cake specifically designed for a legal, constitutional same-sex wedding. His case was just argued in the Supreme Court no less. The staggering victories of the marriage-equality movement (now, Australia!) have led us here — far sooner than most of us pioneers ever contemplated. And the speed and finality of this social change has — understandably — frightened, disturbed, and alienated many on the other side. RYAN T. ANDERSON December 7, 2017 4:00 AM NATIONAL REVIEW Disagreements are not necessarily discrimination in need of legal remedy. On December 5, the Supreme Court heard the case of Jack Phillips, the Christian baker who can’t in good conscience design and create wedding cakes that celebrate same-sex marriages. The justices now will decide whether states, consistent with the First Amendment, can force citizens to express support for same-sex marriage through their artistic products. But this case needn’t have ended up at the Court. And future cases like it can be avoided. Agree or disagree, but Phillips believes he is serving Christ with every cake he makes. He has previously turned down requests to create Halloween-themed cakes, lewd bachelor-party cakes, and a cake celebrating a divorce. He was never reprimanded over those decisions, but the same-sex-wedding cake plunged him into hot water.
